These Terms of Use and Sale govern access to and use of Lello.Store and purchases made through the website.
The website is operated by Callegari 520 LLC, doing business as Lello.Store, referred to in these Terms as “Lello.Store,” “Lello,” “we,” “us,” or “our.”
By accessing the website, creating an account, submitting an order, or otherwise using our services, you agree to these Terms and to the policies incorporated into them by reference.
Please do not use the website or submit an order if you do not agree to these Terms.
1. Eligibility
You must be at least the age of legal majority in your jurisdiction to place an order.
By submitting an order, you represent that:
- You are legally capable of entering into a binding agreement
- The information you provide is accurate and complete
- You are authorized to use the payment method submitted
- Your purchase and intended use of the products are lawful
The website is intended primarily for customers located in the United States.
2. Shopify and the Online Store
Our online store is hosted through Shopify, which provides the e-commerce platform used to display products, process orders, facilitate payments, and provide related website functions.
Your use of payment services, Shop Pay, accelerated checkout services, or other third-party features may also be governed by the applicable provider’s terms and privacy practices.
3. Products and Availability
Products offered through Lello.Store may include gourmet foods, beverages, pantry provisions, tabletop goods, kitchen accessories, books, gifts, home objects, and other curated merchandise.
Certain products may be:
- Available only online
- Produced in limited quantities
- Imported or seasonally available
- Offered as a preorder or backorder
- Subject to purchase limits
- Discontinued without prior notice
Placing a product in a shopping cart does not reserve it. Product availability remains subject to final inventory verification.
We may limit quantities purchased per customer, household, payment method, address, account, or order when reasonably necessary to protect inventory, prevent fraud, preserve limited availability, or prevent unauthorized resale.
4. Product Descriptions and Images
We make reasonable efforts to present products accurately, including their appearance, dimensions, ingredients, origin, quantity, packaging, and intended use.
However:
- Screen settings may affect how colors appear
- Packaging and labels may be updated by the manufacturer
- Product photography may include props not included with the purchase
- Dimensions and weights may be approximate
- Imported packaging may differ from photographs
- Minor typographical errors or omissions may occasionally occur
The product name, selected variant, quantity, and contents expressly stated on the product page determine what is included with the purchase.
When a listing contains a material error, we may correct the information and contact affected customers before fulfillment.
5. Food Ingredients, Allergens and Dietary Information
We make reasonable efforts to reproduce ingredient, allergen, dietary, nutritional, storage, and preparation information supplied by manufacturers or shown on product packaging.
Manufacturers may change ingredients, recipes, processing facilities, labeling, packaging, or allergen statements without immediately notifying retailers.
Customers with allergies, intolerances, medical dietary restrictions, or other sensitivities must:
- Read the product label and complete ingredient statement before consumption
- Review the allergen statement each time the product is purchased
- Avoid consuming a product when the label is missing, illegible, inconsistent, or raises a concern
- Contact us before ordering when additional manufacturer information is needed
Unless expressly confirmed in writing by the manufacturer, the absence of a particular allergen from a website description does not guarantee that cross-contact is impossible.
Do not consume a product if its seal appears compromised, the container is swollen or leaking, or the product appears spoiled, damaged, tampered with, or otherwise unsafe.
Packaged foods regulated by the FDA are subject to ingredient and major-allergen labeling requirements, but customers should still review the complete physical label because formulations can change.
6. General Food and Lifestyle Information
Recipes, serving suggestions, articles, storage guidance, entertaining ideas, and other editorial content are provided for general informational and inspirational purposes.
They are not medical, nutritional, dietary, or food-safety advice tailored to an individual.
Customers should consult an appropriate qualified professional regarding allergies, medical conditions, medication interactions, pregnancy, specialized diets, or other health concerns.
7. Artisanal and Natural Variation
Many products are handcrafted, traditionally produced, naturally derived, aged, harvested seasonally, or made in limited batches.
Reasonable variation may occur in:
- Color
- Flavor and aroma
- Texture
- Shape and dimensions
- Finish and pattern
- Label placement
- Packaging
- Natural sediment or separation
Such variation is not ordinarily considered a defect when it does not materially affect product safety, identity, quality, or intended use.
8. Imported Products and Date Formats
Imported products may contain multilingual packaging or use date formats different from customary United States formats.
A date may appear in day/month/year format rather than month/day/year format.
“Best By,” “Best Before,” and similar markings generally concern expected product quality, unless the manufacturer or applicable law indicates otherwise.
Customers should contact Customer Care before consuming a product when a date, translation, storage instruction, seal, or product condition is unclear.
9. Orders and Acceptance
Submitting an order constitutes an offer to purchase the selected products under these Terms.
An automated order confirmation acknowledges that we received the order. It does not necessarily mean that:
- The order has been accepted
- Payment has completed final verification
- Inventory has been confirmed
- The order has shipped
We may review, verify, accept, limit, hold, or decline an order before shipment.
Reasons may include:
- Product unavailability
- Pricing or listing errors
- Payment authorization failure
- Suspected fraud or unauthorized activity
- Incorrect or incomplete customer information
- Shipping restrictions
- Excessive quantities
- Suspected unauthorized resale
- Previous unresolved payment disputes
- A product failing final quality inspection
When we cancel a paid order or an affected portion before shipment, we will issue the appropriate refund to the original payment method.
We will not substitute a materially different product without the customer’s approval.
10. Pricing, Payment and Taxes
Prices are displayed in United States dollars unless otherwise stated.
Prices, promotions, shipping charges, and product availability may change without advance notice. Changes do not ordinarily affect an order already accepted, except where correction of a material error is permitted by law.
The customer authorizes us and our payment providers to charge:
- The product price
- Shipping and handling
- Applicable taxes
- Other charges clearly disclosed before order submission
Applicable sales tax is calculated according to the delivery destination and information available at checkout.
11. Pricing and Listing Errors
Although we make reasonable efforts to maintain accurate listings, a product may occasionally be displayed with an incorrect price, description, image, promotion, shipping charge, or availability status.
When an error is discovered before shipment, we may:

- Contact the customer for instructions
- Offer the product at the corrected price
- Cancel and refund the affected product or order
We are not required to fulfill an order at an obviously erroneous price when doing so is not required by applicable law.
12. Payment Verification and Fraud Prevention
We may use Shopify, payment processors, carriers, fraud-prevention providers, and other service providers to verify order and payment information.
We may request reasonable verification before fulfilling an order, including confirmation of:
- Billing information
- Shipping information
- Identity
- Payment authorization
- Relationship between the purchaser and recipient
Failure to provide reasonably requested verification may result in delay or cancellation.
13. Shipping and Delivery
Orders are governed by our Shipping and Delivery Policy, which is incorporated into these Terms.
Processing and delivery estimates are not guarantees unless expressly described as guaranteed.
Customers are responsible for providing a complete and accurate shipping address and for arranging a reasonably secure delivery location.
Carrier delays, delivery scans, damage, address errors, returned packages, missing packages, and related concerns will be handled under the Shipping and Delivery Policy and applicable law.
Federal rules generally require online sellers to ship within the promised timeframe or provide an appropriate delay notice and cancellation opportunity.
14. Returns, Refunds and Order Issues
Returns, refunds, damage claims, missing products, fulfillment errors, cancellations, and exchanges are governed by our Returns, Refunds & Order Issues Policy, which is incorporated into these Terms.
Food, beverages, opened consumables, and other products that cannot safely be restocked are generally final sale, except when an appropriate remedy is required for damage, defect, compromise, incorrect fulfillment, or applicable law.
Refunds are issued to the original payment method unless another resolution is agreed upon or required by law.
15. Chargebacks and Payment Disputes
Customers are encouraged to contact Customer Care promptly regarding a billing or order concern so that we have an opportunity to investigate and resolve it.
Nothing in these Terms waives or limits any lawful right to dispute a charge with a card issuer or payment provider.
Providing false information, claiming that an authorized transaction was unauthorized, or pursuing duplicate recovery through both Lello.Store and a payment provider may constitute misuse of the service.
We may provide order confirmations, correspondence, tracking information, delivery evidence, policy records, and other relevant documentation when responding to a payment dispute.
16. Promotions, Discount Codes and Complimentary Gifts
Promotions are subject to the terms displayed with the offer.
Unless otherwise stated:
- Promotions cannot be combined
- Discount codes have no cash value
- Discounts cannot be applied retroactively
- Promotions may be limited by product, customer, date, quantity, or location
- Complimentary gifts are available while supplies last
- Promotional abuse may result in cancellation
When a return causes an order to no longer qualify for a promotion, gift, or quantity discount, the refund may be adjusted as described in the Returns Policy.
17. Gift Cards
Gift cards are subject to any additional terms displayed when purchased.
Gift cards:
- May be used only through eligible Lello.Store sales channels
- Cannot ordinarily be replaced if lost, stolen, or used without authorization
- Cannot be redeemed for cash except where required by law
- May not be used for unlawful, fraudulent, or unauthorized purposes
Gift cards are not bank accounts, credit cards, or interest-bearing instruments.
18. Customer Accounts
Customers may be permitted to create an account for order history, saved information, or other conveniences.
You are responsible for:
- Maintaining the confidentiality of account credentials
- Restricting access to your device
- Providing accurate account information
- Promptly notifying us of suspected unauthorized use
We may suspend or terminate an account when reasonably necessary to address fraud, misuse, security concerns, or violations of these Terms.
19. Reviews, Photographs and Customer Submissions
When you voluntarily submit a review, photograph, testimonial, comment, recipe, suggestion, or other content, you represent that:
- You created it or have permission to submit it
- It is accurate and not misleading
- It does not violate another person’s intellectual-property, privacy, or publicity rights
- It is not unlawful, defamatory, threatening, obscene, or fraudulent
- It does not contain malicious code or unauthorized advertising
You grant Lello.Store a nonexclusive, worldwide, royalty-free license to reproduce, display, edit for length or formatting, distribute, and use the submission in connection with our business and marketing.
We are not required to publish or retain submissions and may remove content that violates these Terms.
20. Intellectual Property
The website and its contents—including branding, logos, text, product curation, original photography, graphics, layouts, articles, recipes, and design elements—are owned by or licensed to Callegari 520 LLC and are protected by applicable intellectual-property laws.
You may use the website for personal, noncommercial shopping and informational purposes.
Without prior written authorization, you may not:
- Copy or republish substantial website content
- Use our branding in a misleading manner
- Scrape or systematically extract website data
- Reproduce original photographs for commercial use
- Create derivative commercial materials
- Imply sponsorship, endorsement, or affiliation
- Circumvent website security or access restrictions
Manufacturer names and trademarks remain the property of their respective owners.
21. Prohibited Uses
You may not use the website or services to:

Where liability may lawfully be limited, our total liability relating to an order will not exceed the amount paid for the product or order giving rise to the claim.
These limitations do not apply where liability cannot legally be excluded or limited, including where applicable to fraud, willful misconduct, gross negligence, personal injury, or non-waivable consumer rights.
Some jurisdictions do not permit certain exclusions or limitations, so parts of this section may not apply to every customer.
26. Indemnification
You agree to indemnify and hold harmless Callegari 520 LLC and its members, employees, contractors, agents, and service providers from third-party claims, liabilities, damages, and reasonable expenses arising from:
- Your unlawful misuse of the website
- Your violation of these Terms
- Content you submit
- Your infringement of another person’s rights
- Fraudulent or unauthorized activity attributable to you
This provision does not require a customer to indemnify Lello.Store for Lello.Store’s own unlawful conduct, negligence, or breach of duty.
27. Events Outside Our Reasonable Control
We are not responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, natural disasters, labor disruptions, carrier failures, transportation interruptions, customs delays, governmental action, public-health emergencies, internet outages, supplier disruptions, or other force-majeure events.
This section does not eliminate any obligation to provide required delay notices, cancellation options, refunds, or other remedies under applicable law.
28. Suspension and Termination
We may suspend or terminate access to the website or services when a user materially violates these Terms, creates a security risk, engages in fraud, abuses promotions, or unlawfully interferes with our operations.
Terms that by their nature should survive termination—including payment obligations, intellectual property, liability limitations, indemnification, and dispute provisions—will remain effective.
29. Governing Law
These Terms and transactions with Lello.Store are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.
Nothing in this section deprives a consumer of mandatory protections provided by the law of the consumer’s state of residence when those protections cannot lawfully be waived.
The parties consent to the jurisdiction of courts having lawful authority over disputes involving Callegari 520 LLC, subject to applicable consumer-protection and small-claims rules.
30. Severability
If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed when necessary.
The remaining provisions will continue in effect.
31. No Waiver
A failure or delay in exercising a right under these Terms does not waive that right.
A waiver is effective only when made expressly and in writing by an authorized representative of Lello.Store.
32. Assignment
Customers may not assign their rights or obligations under these Terms without our written consent.
We may assign these Terms in connection with a merger, acquisition, sale of assets, restructuring, or transfer of the business, subject to applicable law.
33. Entire Agreement
These Terms, together with the Privacy Policy, Shipping and Delivery Policy, Returns and Refunds Policy, and any specific promotional or product terms, constitute the agreement governing use of the website and purchases from Lello.Store.
34. Changes to These Terms
We may update these Terms to reflect changes in our operations, services, legal obligations, or business practices.
The updated version will be posted on this page with a revised date.
Changes apply prospectively unless applicable law permits or requires otherwise.
